See, while they "could" put her on the sex offenders register, the real problem then wont be that she's on it, but that it will make the entire thing wind up looking stupid, and thereby worthless.

"He's on the sex offenders register? So what? I know a girl of 14 who was put on it for taking her own pictures!"

It just means that unless you know actual details of someone's case, the fact they're on that register will be meaningless.

It's the same as the kids who are getting in trouble over child porn because they recorded themselves having sex with someone of their own age... It's basically taking the context of the law and using it in a way it wasn't really meant for, which was to protect the underaged against actual paedophiles. It's now being used because it's easy to make a quick arrest.
