Yellowtop: Guilty or Not Guilty?

Thank you for taking the time to look at this thread. Yellowtop is going through his final boni from our Bad Management game: Alyssandra's (http://www.getdare.com/bbs/showthread.php?t=281055&highlight=names&page=38). To keep with the roleplaying theme of that game, Yellowtop has been "charged" with some crimes. You all now serve as his jury. Below you will see closing arguments and any supporting evidence. (I will only be posting evidence for the prosecution. You may wish to wait for Yellowtop to post any evidence for his defense before choosing a verdict.)

If found guilty on one count, Yellowtop will be fined equal to the number of guilty votes. If found guilty on both counts, we will double that number. You are welcome to post recommendations of ways Yellowtop can pay off his fine, which may be integrated.

Additionally you can add to Yellowtop's fine the following ways:

1 orgasm = 1 increase (limited to 1/day)
1 sweet treat licked 5 times/hour for 3 hours before consuming = 1 increase (limited to 1/day)
10 minutes of exercise = 1 increase (limited to 3/day)

If you want to take mercy on Yellowtop, you can decrease his fine by:

Prosecutors are saying Mr. Yellowtop skimmed profits from Alyssandra's, feeding an offshore account. Additionally, Mr. Yellowtop claimed tax benefits for 3 times the amount of employees than he actually employed by registering his employees under multiple names. By doing this, he also avoided paying his employees overtime and full time benefits.

"When asked for comment his aunt stated Mr. Yellowtop acted without consulting her and that the charges rested squarely on his shoulders.

"Mr. Yellowtop notably had ties to President-Elect Trump as he was considered for various cabinet positions. Just an hour ago Trump took to Twitter to comment: "Mr. Yellowtop is a liar and deceiver. I have always hated him. Sad. #Lyingtop"

"Given Mr. Yellowtop's high profile, prosecutors are pushing for a fast trial."

The case for the defence: The multiple escort names were
the idea of Ms Orsini, the outside consultant. Mr Yellowtop left the
preparation of the payroll and tax affairs to his secretary, Miss Jones.
Mr Yellowtop notes that Ms Orsini, in her role as outside consultant,
could also have influenced Ms Jones in these affairs. Of course she may
deny it, but can the jury be sure, beyond reasonable doubt, that this is
not the case?

As for the money in offshore accounts, that money was merely resting in
those accounts prior to being transferred to its proper destination.
There is no question of any embezzlement here.

In short, Mr Yellowtop my be a bad manager, but he is not a criminally bad
manager. Not in that sense at least.

Ladies and gentlemen of the jury. Mr. Yellowtop is accused of some serious crimes today. Throughout this trial you have seen evidence that he not only embezzled money from his own company, but that he denied benefits from his hard working employees by forcing them to work under aliases. This allowed him to manipulate the books to show he had more employees than he actually had. And since each employee was employed part time, he gladly denied them health care and overtime pay required by law.

On the first count of embezzlement, in Mr. Yellowtop's own plea, he admitted to moving the money to an offshore account. His defense claims that it was only a temporary move, but Mr. Yellowtop is a savvy businessman. He knew that moving the money to that account would help him avoid the higher taxes his booming business was going to receive. In addition, Lola Bunny states she was advised not to answer any calls from government agencies asking about the company's books.

On the second count of fraud, Mr. Yellowtop's defense claimed that the idea was not even his own. While Miss Orsini did provide advice to change the employee's names, she never told him to create multiple personas for each employee. That idea came from Mr. Yellowtop directly. Therefore the fraud that resulted rests squarely on his shoulders.

Given this evidence, you must convict Mr. Yellowtop of all crimes of which he stands accused. Thank you for your time.

I am pretty convinced that yellowtop must be guilty on both counts. But fair as I am I give the defense time but no chance to change my mind. That Ms. Orsini already looks so innocent, she cannot be involved at all. Just my humble, confident opinion. :D
This Ms. Jones is just a loyal secretary. And the poor fellows of escorts were exploited in the worst. It's all the (bad) management's fault, of course. As always.

In fact, I hope the hot licensed US attorney for the defense torments the own client and embarrasses and humiliates yellowtop even more. Isn't there any (made-up) reason for the defense to have yellowtop being strip naked, collared, gagged and restraint in court? Is the US attorney for the defense going to agree to the request by the prosecutor to hand over and open all books because yellowtop got nothing to hide?

Yellowtop looked over the jury, searching for a sympathetic face, but was met with 17 cold stares. Only one guy seemed to be somewhat neutral, and he looked away. Odd, thought yellowtop, I thought there were only 12 people on a regular jury......

Still, his lawyer had promised to get him off. He was a local, so he must know what he was doing. Yellowtop glanced at the man's business card;

He was about to make his closing speech;

"Ladies and Gentlemen of the Jury, we are here today to determine the
guilt or innocence of this young man in the dock. It is a grave responsiblity.
I want you all to look at Mr Yellowtop and imagine, it could be your son or daughter, husband, wife, or you yourself in his place. I'm sure, if that were so, you would want the jury to deliberate carefully. Remember, we are not here to decide if yellowtop is probably guilty, but whether he is guilty beyond reasnable doubt. It's a crucial distinction.

We are asked to believe that Mr Yellowtop is a criminal mastermind, manipulating the events at Alyssandra's to his own advantage. However,
the defence will claim that Mr Yellowtop is instead a dreamer with a megalomaniac streak. Very bad qualities in a business manager, but not in themselves criminal.
